Suspect arrested, charged with felony murder, in Baileyton shooting

CULLMAN – The Cullman County Sheriff's Office (CCSO) has arrested Robert L. Kimbrough, 27, of Arab for felony murder (AL Code 13A-6-2(a3)) and first-degree burglary in connection with the fatal shooting that occurred in the Baileyton community on Tuesday, April 4.

Johnathan Andrew Smith, 34, of Blountsville was shot when he and Kimbrough allegedly entered the home of Mike Sweaton on County Road 1759 some time after 8 a.m. Tuesday. Sweaton shot Smith.

Cullman County Sheriff Matt Gentry says that an altercation ensued at the residence. "We believe this was an isolated incident. The individuals knew each other, and the individual in the house was targeted by the two suspects. It was not random."

After the shooting, Smith and Kimbrough fled the home in a vehicle. Authorities located the vehicle in the 5800 block of Highway 67 a short time later. Smith's body was inside. Kimbrough fled on foot.

A K-9 deputy with the CCSO was brought in, along with a helicopter from the Cullman City Police Department (CPD), to search for Kimbrough; however, he eluded authorities until Thursday, April 6.

Kimbrough is currently being held in the Cullman County Detention Center without bond.

AL Code 13A-6-2 (a3) states:

A person commits the crime of murder if he or she commits or attempts to commit arson in the first degree, burglary in the first or second degree, escape in the first degree, kidnapping in the first degree, rape in the first degree, robbery in any degree, sodomy in the first degree, any other felony clearly dangerous to human life and, in the course of and in furtherance of the crime that he or she is committing or attempting to commit, or in immediate flight therefrom, he or she, or another participant if there be any, causes the death of any person.
