(Updated) Vinemont man charged after shooting in Zaxby’s parking lot in north Cullman

CULLMAN, Ala. – Joseph Allen Gaines, 55, of Vinemont is facing multiple charges after allegedly shooting into an occupied vehicle in the parking lot of Zaxby’s along U.S. Highway 157 in Cullman Sunday afternoon.

Cullman Police Sgt. Trey Higginbotham said the incident occurred around 4:18 p.m.

“We had a subject fire a weapon from his vehicle and struck an occupied vehicle in the parking lot,” he said. “We found the suspect vehicle and attempted to stop him, and he fled from us. We ended up getting him stopped at the Vinemont Condominiums, and he was taken into custody up there.”

Higginbotham said the CPD believes Gaines was aiming at another, unoccupied, vehicle but missed and hit one that was occupied. No one was injured.

Police believe the incident was domestic in nature.

“His ex-girlfriend, or ex-wife, works at Zaxby’s,” said Higginbotham, “and that’s why he was there in the first place.”

Gaines is charged with shooting into an occupied vehicle, reckless endangerment, attempting to elude, first-degree stalking and second-degree unlawful possession of marijuana.
