CULLMAN – Cullman Police arrested Jonathan Kerry Smith, 42, of Cullman early Monday morning at Five Points Grocery. At approximately 2 a.m., CPD received a call from someone who reported seeing three subjects leaving the business, which is located at 205 Rosemont Ave. NW in Cullman.

Upon arrival at the scene, officers observed that one of the business’s windows had been smashed in with a brick. CPD Sergeant Terry Gilliland entered the store, while Officer Roy Bates began searching the property outside.

Smith was located inside the business; however, he managed to get outside and take off on foot.

“He took off east towards Rosemont Avenue, but it was easy to track him because he left a trail of cigarettes and rolls of pennies that were falling out of his pockets. There were $2.50 in rolls of pennies found,” said Officer Adam Clark.

Officers Jerry Perkins and Anthony Austin captured Smith on foot and took him into custody.

Smith told the officers that he just got out of prison on March 1 after serving 16 years. An internet search of his incarceration record confirmed his statement.

Smith is charged with third-degree burglary, possession of burglary tools, public intoxication and attempting to elude law enforcement.

He is being held at the Cullman County Detention Center on a $13,000 bond.
